The website www.centredentairebelcenia.fr (hereinafter the "Site"), published by SCP INCHAUSTI JACQUET MARFAING LEROY (hereinafter "we").

Access, consultation, navigation and/or use of the Site and its services constitutes full and complete acceptance of these general terms and conditions of use (hereinafter "GCU"), the purpose of which is to define the terms of use of the Site and its services by any person accessing, consulting, browsing and/or using all or part of the Site and its services (hereinafter "User").

Consequently, before any use of the Site and its services, the User is invited to read these GCU. If the User refuses, in whole or in part, any of the stipulations of these GCU, he is requested not to use the Site and its services.

These T&Cs are accessible at any time on the Site and will prevail, where applicable, over any other version or any other contradictory document.

The User is informed that any online appointment booking via the Doctolib platform integrated into the Site is subject to the Doctolib Services Terms of Use and Doctolib's personal data protection policy.

 

Article 1 – ACCESS TO THE SITE AND SERVICES
Access to the Site and its services is technically possible twenty-four (24) hours a day, seven (7) days a week, subject to the occurrence of a case of force majeure, possible breakdowns or any maintenance operation necessary for the proper functioning of the Site and its services.

In any event, the User acknowledges having the skills and means necessary to access and use the Site and its services. As such, the User must have a computer, mobile phone, tablet or any other device with an internet connection, the settings of which allow the Site and its services to function properly.

In general, the User declares that they are aware of the risks associated with browsing websites and using online services and accept them. The User acknowledges in particular that the information that passes through or is stored there may be intercepted or altered beyond our control.

As such, the User is strongly recommended to take all necessary precautions to protect themselves against the effects of possible computer hacking, in particular by adopting a secure and suitable computer configuration for their computer, mobile phone, tablet or any other device used (for example, by installing regularly updated virus detection software).

 

Article 2 – SERVICES OFFERED ON THE SITE
2.1. Conditions of access to the services offered on the Site

To benefit from the services offered on the Site, the User must:

• be of legal age;
• have the capacity and quality required to benefit from the Site's services;
• use the Site and its services in accordance with these T&Cs.

 

In addition, access to the services offered on the Site sometimes involves filling in the mandatory fields of the form associated with the desired service. The User guarantees the truthfulness and accuracy of the information communicated in this context. To learn more about the use of their personal data and how to exercise their rights in this regard, the User is invited to consult the data protection policy.

Article 3 – GENERAL OBLIGATIONS OF THE USER
The User is prohibited in particular from:

• using the Site and its services for commercial, prospecting, solicitation or advertising purposes.
• any behavior likely to undermine the integrity, operation or security of the information system underlying the operation of the Site and its services;
• any intrusion or attempted intrusion into our information systems
• any breach or attempted breach of the Site's security measures;
• any collection, extraction or use, in any way whatsoever, of the information present on the Site;
• and more generally, any act likely to infringe the rights and interests of SCP INCHAUSTI JACQUET MARFAING LEROY.

In the event of a breach of these T&Cs or the regulations in force, including any unauthorized use of the Site and its services, we reserve the right to terminate this contractual relationship, automatically, without notice or compensation, and to block any future access by the User to all or part of the Site and its services.

Article 4 – INTELLECTUAL PROPERTY
The Site and all elements that compose it or that are made available to Users, in particular brands, logos, photographs, programs, source codes, object codes, data, databases, animated or non-animated images, sounds, drawings, graphics, videos, texts, layout, appearance, structure, as well as any other element not linked to hypertext links to third-party sites, are the property of SCP INCHAUSTI JACQUET MARFAING LEROY or are the subject of a license granted to it by any holder of intellectual property rights.

All these elements are subject to the provisions of French and international regulations applicable to intellectual property, in particular the Intellectual Property Code and, consequently, are protected against any use not authorized by law or these T&Cs under penalty – in the event of failure – of legal proceedings.

SCP INCHAUSTI JACQUET MARFAING LEROY grants the User a personal, non-exclusive and free right to consult and use the Site and its services for their own use and within the strict framework of the operations authorized under these T&Cs.

Subject to the rights of use granted to the User, the use of the Site and its services does not entail any license or transfer of rights relating to the elements of the Site to the User. The fee rates or ranges of fee rates that may be indicated on the Site are for information purposes only, as is the reimbursement rate by the health insurance in force corresponding to the services offered. The User is informed that the final price of the care service may vary depending on the type of consultation actually carried out and this, in accordance with the care agreements in force by SCP INCHAUSTI JACQUET MARFAING LEROY.

Furthermore, SCP INCHAUSTI JACQUET MARFAING LEROY cannot be held liable for any direct or indirect damage that may result from:

• any malfunction or contamination of the computer, mobile phone, tablet or any other equipment used by the User during or after browsing the Site,
• inability to access or poor conditions of use attributable to this equipment, the internet access provider, internet network congestion, or any other reason external to SCP INCHAUSTI JACQUET MARFAING LEROY;
• electronic or telephone communication costs incurred by the use of this equipment and which are the sole responsibility of the User. any interruption, temporary or permanent, of all or part of the Site's functionalities, in particular in the event of maintenance, modification or updating of the Site, in the event of a technical incident and, more generally, in the event of an event outside the control of SCP INCHAUSTI JACQUET MARFAING LEROY.

In the event that SCP INCHAUSTI JACQUET MARFAING LEROY is held liable for damage not provided for in this article, its liability will be limited to certain, real and direct damage.

Subsequently, under no circumstances may SCP INCHAUSTI JACQUET MARFAING LEROY, its representatives and partners be held liable for indirect damage resulting from the use of the Site, the services offered there and the content published there, and in particular for loss of earnings, loss of profit, loss of opportunity or damage resulting from the loss of data caused by the inability to use the Site and its services.

 

Article 6 – MODIFICATION
These T&Cs are dated precisely and may be modified and updated by SCP INCHAUSTI JACQUET MARFAING LEROY at any time, in particular in the event of changes to the Site or applicable regulations.

The applicable T&Cs are those published on the Site at the time the User accesses the Site. Consequently, the User is invited to consult the T&Cs each time the Site is accessed.

This version of the T&Cs replaces all previous versions.

Article 7 – TERMINATION OF THE SITE
SCP INCHAUSTI JACQUET MARFAING LEROY reserves the right to interrupt, temporarily or permanently, access to all or part of the Site or the services offered there, in particular in the event of cessation of the activity linked to the provision of the Site or in the event of collective proceedings.

Article 8 – ASSIGNMENT
Subject to applicable law, the User agrees that these T&Cs binding him to SCP INCHAUSTI JACQUET MARFAING LEROY may be assigned, transferred or contributed, in any way whatsoever. In the context of the transfer of the company to a third party, these T&Cs binding the User to SCP INCHAUSTI JACQUET MARFAING LEROY will be automatically transferred to the assignee.

Article 9 – HYPERTEXT LINKS

The Site may include hypertext links to external sites or sources, other than those published by SCP INCHAUSTI JACQUET MARFAING LEROY. SCP INCHAUSTI JACQUET MARFAING LEROY may, at its sole discretion, accept or reject any request addressed to it for this purpose. SCP INCHAUSTI JACQUET MARFAING LEROY has no obligation to accept such a request, nor to provide any reason for rejecting such a request if applicable.

 

Article 10 – VALIDITY OF THE T&Cs

Each of the articles of these T&Cs applies separately. Any change in the applicable regulations in force, or any decision by a court or competent authority invalidating one or more articles of these T&Cs shall not affect the validity of the entire T&Cs. Such modification or decision does not authorize the User to disregard the valid provisions of these T&Cs.

 

Article 11 – LANGUAGE

These T&Cs are written in French. In the event that they are translated into one or more languages, only the French text shall be authentic in the event of a dispute.

 

Article 12 – APPLICABLE LAW / ATTRIBUTION OF JURISDICTION

These T&Cs and the operations resulting from them are governed, interpreted and applied in accordance with French law.

In the event of a dispute relating to their interpretation or execution, SCP INCHAUSTI JACQUET MARFAING LEROY and the User shall seek, before any legal action, an amicable agreement and shall communicate to each other all the necessary information for this purpose.

In the absence of an amicable agreement between SCP INCHAUSTI JACQUET MARFAING LEROY and the User within two (2) months from notification of the dispute to the other party, express jurisdiction is given to the courts of Bayonne.
